Sn1perSecurity LLC ("Sn1perSecurity," "we," "us," or "our") operates the SILENTCHAIN AI website at silentchain.ai and provides related software, licensing, support, trial, quote, and other services (collectively, the "Services"). This Privacy Policy explains how we collect, use, disclose, and retain information in connection with the Services.

1. Information We Collect

1.1 Information You Provide

Depending on how you interact with us, we may collect information such as your name, email address, company or organization, job title, billing or other address information, purchase and license information, and information you choose to provide through communications, support requests, trial or quote requests, surveys, feedback, or other forms.

We may also receive transaction and customer information from payment and other service providers when necessary to process purchases, provide licenses, provide support, prevent fraud, resolve disputes, or maintain business records.

SILENTCHAIN software does not currently require or create a user account. SILENTCHAIN is provided using a license-key-based model.

1.2 Payment Information

Purchases are processed through Paddle, which acts as the Merchant of Record for our software purchases. Paddle handles payment processing and related transaction functions.

We may receive information from Paddle necessary to fulfill purchases, provide licenses and support, process refunds or disputes, prevent fraud, and maintain business records. This may include information such as your name, email address, country, purchase amount, product purchased, billing information, and related transaction information.

Paddle may collect and process additional information directly during checkout. Paddle's own privacy practices apply to information it processes directly.

1.3 Information Collected Automatically

When you visit our website or use certain website functionality, we and our service providers may automatically collect certain technical and usage information, such as IP address, browser and device information, operating system information, pages visited, interactions with the website, referring information, timestamps, and related technical information.

We use this information to operate and secure our website, understand website usage, troubleshoot technical issues, and improve our website and Services.

1.4 Information We Do Not Collect Through SILENTCHAIN

SILENTCHAIN software is designed to perform its security-testing functionality locally on the user's machine.

As part of the normal operation of SILENTCHAIN, Sn1perSecurity does not receive or store customers' target URLs, HTTP traffic, vulnerability findings, scan results, source code, file contents, or other scan content on Sn1perSecurity servers.

This does not mean that scan information can never leave the user's environment. As described below, when a user configures a cloud-based AI provider or another third-party service, information may be transmitted to that provider for the functionality selected by the user.

1.5 Third-Party AI Services

SILENTCHAIN may allow users to configure third-party AI services for analysis.

When a cloud-based AI service is selected, information processed by that service may be transmitted to the applicable provider for analysis. Depending on the provider, configuration, and functionality being used, transmitted information may include portions of HTTP requests or responses, URLs, headers, parameters, body content, vulnerability-related information, severity information, parameter names, verification payloads, or other information included in the data submitted for analysis.

SILENTCHAIN may support multiple AI providers and the providers available may change over time. Sn1perSecurity does not control the privacy, security, retention, or processing practices of third-party AI providers.

Users should review the applicable terms, privacy practices, and data-processing terms of any AI provider they choose before using that provider with sensitive information.

Where a locally configured AI service is used, such as a local Ollama deployment, AI processing can occur within the user's own environment rather than being transmitted to a third-party cloud AI provider.

Users are responsible for determining whether transmitting information to a third-party AI provider is appropriate for their circumstances, including their organization's policies, contractual obligations, and applicable legal or regulatory requirements.

SILENTCHAIN is designed to operate with Burp Suite Professional. Third-party software, extensions, integrations, or services separately configured by the user may collect or transmit information independently of SILENTCHAIN. Such activity is governed by the applicable third party's terms and privacy practices.

1.6 Google Analytics

We use Google Analytics to understand how visitors use our website, measure website traffic and usage, troubleshoot issues, and analyze general website and business trends.

Google Analytics may collect information such as pages viewed, interactions with the website, referring sources, device and browser information, approximate geographic information, and related technical information.

We do not currently use Google Analytics for advertising or remarketing, and our Google Analytics property is not linked to Google Ads.

Our use of Google Analytics and its configuration may change from time to time as we maintain and improve our website. If our use of analytics changes materially or is used for a substantially different purpose, we will update this Privacy Policy where required by applicable law.

1.7 Cookies and Similar Technologies

We use cookies and similar technologies to operate, secure, and improve our websites and to provide functionality such as website sessions, shopping-cart functionality, security, language or other preferences, analytics, and other website features.

Some cookies and similar technologies may be placed or used by third-party service providers that provide website, analytics, security, payment, or other functionality on our websites. The specific cookies and similar technologies used may change as we add, remove, update, or replace website functionality and third-party services.

Where applicable law requires consent for particular cookies or similar technologies, we will take reasonable steps to comply with applicable requirements.

We do not currently use third-party advertising cookies or cross-site behavioral advertising technologies for our own advertising purposes.

1.8 License Validation and Telemetry

SILENTCHAIN Professional requires license activation and periodic license validation.

License-related communications may transmit information such as:

  • license key;
  • machine fingerprint or other device identifier;
  • software version and build information;
  • operating system information;
  • hostname;
  • license token;
  • aggregated usage information relevant to licensing and product operation; and
  • IP address associated with license validation requests.

This information is used for license validation, licensing operations, troubleshooting, security, fraud prevention, abuse prevention, and service improvement.

Telemetry does not include target URLs, scan results, vulnerability findings, HTTP traffic, source code, file contents, or the content of data being scanned.

The specific technical information transmitted may change as we maintain, secure, troubleshoot, and improve our licensing and telemetry systems. We will update this Privacy Policy where required by applicable law if there is a material change to the types of personal information collected or the purposes for which it is used.

License data is stored locally on the user's machine. SILENTCHAIN provides a limited offline grace period when the license service cannot be reached.

2. How We Use Information

We may use information we collect to:

  • provide, operate, maintain, and support our Services;
  • process and fulfill purchases and provide licenses;
  • communicate with customers regarding purchases, licenses, support, trials, quotes, and other requested services;
  • respond to questions, requests, surveys, and feedback;
  • send marketing communications to individuals who have subscribed to our marketing mailing list;
  • analyze website, customer, purchase, and product trends;
  • develop aggregated or otherwise appropriately de-identified business insights, including understanding customer types, geographic markets, product demand, and other business trends;
  • detect, prevent, and address fraud, abuse, unauthorized use, security issues, and technical problems;
  • maintain business, accounting, tax, transaction, and license records;
  • enforce our agreements and protect our rights; and
  • comply with applicable legal obligations.

3. Legal Bases for Processing

If applicable data protection law, including the GDPR or UK GDPR, applies to our processing of your personal information, we rely on one or more of the following legal bases depending on the circumstances:

  • Contract: Processing necessary to provide a product, license, trial, quote, support, or other service requested by you.
  • Legitimate interests: Processing necessary for operating, securing, supporting, improving, and protecting our business and Services, including fraud prevention, technical operations, dispute resolution, and appropriate business analytics.
  • Consent: Where we request consent, such as for certain marketing communications or where consent is required for certain cookies or similar technologies.
  • Legal obligations: Processing necessary to comply with applicable laws or legal requirements.

Where we rely on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that occurred before the withdrawal.

4. How We Share Information

We do not sell personal information to data brokers or operate a business based on selling personal information.

We may disclose information to service providers and other third parties when reasonably necessary to operate our business and provide the Services.

These may include providers of:

  • payment processing and transaction services;
  • website and cloud hosting;
  • business email and communications;
  • marketing email services;
  • analytics and website measurement;
  • website security and fraud prevention;
  • website, form, and shopping-cart functionality; and
  • third-party AI services selected or configured by the user.

We may also disclose information:

  • when required by applicable law, legal process, or government request;
  • when reasonably necessary to protect the rights, property, safety, or security of Sn1perSecurity, our users, or others;
  • to investigate fraud, abuse, security incidents, or other unlawful activity;
  • in connection with a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction; or
  • with your direction or consent.

5. Marketing Communications

We may use a third-party email marketing service to send marketing communications to individuals who have explicitly subscribed to our marketing mailing list.

Marketing communications may include information about products, services, updates, news, or other information relating to Sn1perSecurity.

You may unsubscribe from marketing communications at any time by using the unsubscribe mechanism included in the communication or by contacting us.

We may maintain information necessary to administer our marketing list and honor unsubscribe or other communication preferences.

A purchase or other interaction with Sn1perSecurity does not by itself mean that you have subscribed to our marketing mailing list.

6. Data Retention

We do not apply a single fixed retention period to all information.

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing Services, maintaining licenses, supporting customers, processing or defending against refunds and chargebacks, resolving disputes, preventing fraud, maintaining business and accounting records, complying with legal obligations, and protecting our rights.

Different types of information may therefore be retained for different periods depending on its purpose and our legal or business needs.

We may retain information for longer where reasonably necessary to establish or defend legal claims, resolve disputes, comply with legal obligations, maintain transaction or license records, prevent fraud or abuse, or otherwise protect our rights.

When information is no longer reasonably necessary for these purposes, we may delete, anonymize, or otherwise dispose of it in accordance with our ordinary business practices.

7. Data Security

We use reasonable measures appropriate to the nature of the information and our business to protect personal information against unauthorized access, use, alteration, or disclosure.

These measures may include encrypted communications where appropriate, access controls, and other security measures used in the ordinary operation of our systems.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security.

8. Your Choices and Rights

You may contact us regarding personal information we maintain about you.

Depending on applicable law, you may have rights to:

  • request access to personal information we maintain about you;
  • request correction of inaccurate information;
  • request deletion of personal information, subject to applicable legal and other exceptions;
  • object to or request restriction of certain processing;
  • withdraw consent where processing is based on consent;
  • request applicable data portability; and
  • opt out of marketing communications.

You can unsubscribe from marketing emails using the unsubscribe mechanism provided in those emails. You may also contact us to request removal from our marketing mailing list.

Some requests may be subject to legal exceptions or may not apply to information that we are permitted or required to retain. For example, Sn1perSecurity may retain information reasonably necessary for legal obligations, fraud prevention, abuse prevention, security investigations, dispute resolution, accounting, tax and transaction records, license verification, enforcement of this Agreement, establishing or defending legal claims, or other legitimate and lawful purposes.

We may decline to delete, alter, or suppress information where doing so would interfere with these purposes or where we are otherwise permitted or required by applicable law to retain the information.

If applicable data protection law provides you with a right to lodge a complaint with a data protection supervisory authority, you may exercise that right.

9. International Processing

Sn1perSecurity is based in Arizona, United States.

Our service providers and business operations may process information in the United States and other countries. These providers may include Paddle, DigitalOcean, Google, Titan, Brevo, and other providers described in this Privacy Policy.

Where applicable law requires safeguards for international transfers of personal information, we will use an appropriate legally recognized transfer mechanism.

10. Children's Privacy

Our Services are intended for professional and business use and are not directed to children.

We do not knowingly collect personal information from children through the Services.

If we become aware that we have knowingly collected personal information from a child in circumstances where applicable law requires us to take action, we will take appropriate steps to address the information.

11. Third-Party Websites and Services

Our website and Services may contain links to or integrations with third-party websites and services, including services such as GitHub, YouTube, Paddle, AI providers, and other third-party services.

We are not responsible for the privacy practices of third-party websites or services that we do not control. We encourage you to review their applicable privacy policies and terms.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our Services, information practices, legal requirements, or other circumstances.

Updated versions will be posted on this website with a revised "Last Updated" date. Where required by applicable law, we will provide additional notice or obtain consent for material changes.

Your continued use of the Services after an updated Privacy Policy becomes effective constitutes acknowledgment of the updated Privacy Policy to the extent permitted by applicable law.
